General Terms and Conditions (GTC)

Company information
The travel agent for your trip is Casons Travels PVT Limited, Travel Agent License Number TA/2019/0394, issued to carry on business as a travel agent.
Civil Aviation Authority of Sri Lanka, Air Transport License - Group "A" (Passenger Transport). License Number A-1085.
Member of Sri Lanka Association of Inbound Tour Operator since 2017.


Booking a tour with the aforementioned tour operator constitutes your agreement to the Terms & Conditions below.

Please take time to read carefully the following terms and conditions for your own information and protection. It is your responsibility to ensure that you have read and understood the various terms associated with your contract before placing any bookings.

1. Our Agreement With You

Products and Suppliers
We are Casons Travels, a TRAVEL AGENCY & TOUR OPERATOR acting as intermediary or a “Booking Agent” for products and services that are not directly supplied by us (e.g., air carriage and ground transportation, hotel accommodations, meals, tours, cruises, Travel Insurances, Excursions, Rent-A-Car etc.) and we look forward to the opportunity to act as your booking agent for your travel needs. These general terms and conditions ”GTC” describe what you are legally entitled to expect from us when you purchase travel related services through us, in addition to your obligations as a customer. The terms “we”, “us” and “our” refer to Casons Travels PVT Limited. The term “you” and “your” refers to the customer visiting our website, booking a reservation through us or otherwise using our services; also, the term “you” and “your” include the first named person on the booking and all the persons on whose behalf a booking is made or any other person to whom a booking is added or transferred.

We sell a variety of travel related products from different suppliers and service providers. Each Supplier has its own terms and condition that are applicable to your particular arrangements in addition to our general terms and conditions, and you should make sure you understand them. Certain software and content found on our website are owned or licensed by us or our Suppliers, your use of which may be subject to further conditions. 

All airlines tickets are subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by a supplier or government. You may be charged additional sums by Casons Travels PVT Limited to offset increased fees, fuel surcharges, Highway Tolls, taxes, and fluctuation in foreign exchange markets or any combination thereof. Acceptance of these GTC hereby consent you to any post-purchase price increases and authorize Casons Travels PVT Limited to charge my credit card for such additional amounts.

When you make a booking you guarantee that you have the authority to accept, and do accept on behalf of your party, the terms of these booking conditions. This contract is made on the terms of these booking conditions, which are governed by law, and the jurisdiction of the Courts.
Casons Travels acts at all times as a booking agent or disclosed retail agent on behalf of the supplier(s) involved with your holiday booking. As a Travel / booking agent / Tour Operator or disclosed retail agent, the company’s role is to ensure that all travel components/services booked correspond with what has been agreed with you at the time of booking. In the case of those components/services deviating from what has been agreed due to the supplier(s’) inability to honour the contract, then Casons Travels will open a communication dialogue between the relevant supplier(s) and the customer and will not be liable for any compensation claims. In this context, Casons Travels cannot be held responsible for any changes imposed by the suppliers nor can be considered liable for any omissions/mistakes, unless the latter occur due to our negligence. Ultimately, the customer will enter into a trading relationship with Casons Travels PVT Limited, which will be restricted solely to the above mentioned role of the company as a booking agent or disclosed retail agent, as well as with the various suppliers involved who will have the responsibility to provide in full the services or products advertised at the time of booking.

Deposits and Payment
You will be required to pay a deposit or make full payment for your booking at the time of booking. Where you only pay a deposit you must pay the full balance by the balance due date notified to you. If full payment is not received by the balance due date, we will notify the supplier who may cancel your booking and charge the cancellation fees set out in their Terms and Conditions. Except where otherwise advised or stated in the booking conditions of the supplier concerned, all monies you pay to us for arrangements will be held on behalf of the supplier(s) concerned. Payments by debit or credit cards might be subject to a handling fee.
If you do not pay your outstanding balance within 7 days after the due date, we reserve the right to cancel your booking at loss of deposit.
Upon your provision of your payment information, you are authorizing us to make the payment arrangements with the corresponding Suppliers.
We reserve the right to refuse personal checks or company checks as a method of payment.
If we have arranged a package, changes in transportation costs including the cost of fuel, taxes, fees and exchange rates mean that the price of your travel arrangements may change even after you have paid in full.

All the prices mentioned in the brochures, website or offers are mentioned for one person, in EUR with VAT included.
The prices mentioned in the brochures, website or offers are based on the exchange rates at the moment of publication. Casons Travels PVT Limited reserves the right to modify the selling price as a result of a significant change of the exchange rate. Modifications are announced the latest 30 days prior to the client’s departure. If Casons Travels receives no reply within 8 days after the receipt of this information, the price increase is considered accepted.
If after receiving the full payment of all services initially agreed, you are requesting any other additional services, even if only agreed by email between Parts, Casons Travels PVT Limited has the right to issue invoice for the additional services and you have the obligation to fulfil all payment obligations before the end of the services provided by us, so before you leave the country.

Documentation
Our general practice is to send documents to our customers electronically whenever possible. We reserve the right to charge an administration fee should you make a request for such documents to be sent as a hard copy.

Bookings, Cancellations and Changes

Booking and Changes
These terms of business set out the basis on which we arrange the travel arrangements on your behalf with the third party suppliers.
When you make a booking you guarantee that you have the authority to accept and do accept on behalf of your party these terms of business. This means that you are responsible for making all payments due, notifying us if any changes or cancellations are required and for receiving the confirmation and keeping your party informed.
Any cancellation or amendment request must be sent to us in writing, by email with appropriate Invoice and service(s) provided details, and will take effect on the day we receive this during the hours of 9am to 5pm. You must pay us the cancellation or amendment charge as stated in section Cancellation fees.
With regard to changes and cancellations made by the Hotels, we will inform you as soon as reasonably possible. If we offer alternative accommodation or a refund, you will need to let us know your choice within the time frame we stipulate. If you fail to do so we will assume that you have accepted the change. In the extraordinary event of non-availability, due to overbooking or any other unforeseen circumstance of your booked hotel, a substitute hotel of the same rating will be offered. Casons Travels PVT Limited is not liable for any hotel relocation due to the over-booking hotel policies; Casons Travels PVT Limited shall have to present, if requested, all the documents provided by the over-booked hotel.

Our responsibilities are limited to making the booking in line with your instructions. We do not accept responsibility for any information about the accommodation that we pass on to you in good faith. However, in the event that we are found liable to you on any basis whatsoever, our maximum liability to you is limited to the total cost of your booking (or the appropriate proportion of this if not everyone on the booking is affected). We do not exclude or limit any liability for death or personal injury that arises as a result of our negligence or that of any of our employees whilst acting in the course of their employment.
The booking information that you provide to us will be passed on only to the relevant Suppliers or other persons necessary for the provision of your accommodation. The information may therefore be provided to public authorities such as customs or immigration if required by them, or as required by law. This applies to any sensitive information that you give to us such as details of any disabilities, or dietary and religious requirements. Certain information may also be passed on to security or credit checking companies. In making this booking, you consent to this information being passed on to the relevant persons.
The hotel ratings shown on our website are from our suppliers own rating system and may not be the official rating of the accommodation. Star ratings and standards can differ from country to country and a 4 star accommodation in one country may not be the same standard of a 4 star in another. Casons Travels PVT Limited cannot be held responsible for any misunderstandings relating to official or our suppliers own ratings.

If you have booked a flight and we are alerted to a significant schedule change by your airline before you leave, we will contact you by email to advise you of this. Please ensure that you have given your contact email address to us and that you regularly check for messages before you leave. We have no control over airline schedule changes and accept no liability for costs which may arise as a result of such changes.
After you have left, it is your responsibility to check with the airline that any onward flights you have confirmed are operating as booked. We strongly recommend that you contact your airline at least 72 hours before the scheduled departure of each flight to do this. Please note that for some airlines it is mandatory to confirm with them your intention to fly.

Cancellation fees for hotels, programmes and round trips
If you cancel your arrangements, you may be entitled to a (partial) refund or No Refund, under the condition of the paragraph from below called “Cancellation fees”.
Refunds will only be paid to you once we have received the funds back from the Suppliers. Generally flight tickets cannot be refunded if they are partially used.
If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim your cancellation charges through your insurer.

Cancellation fees
In case of a fixed reservation the pre-booked places are bindingly booked and the client accepts the following cancellation fees may apply and subject to change to non refundable.
On individual and/or difficult dates (i.e. New Year) Casons Travels PVT Limited reserves the right to demand deposits, which are non-refundable in case of cancellation. For individual dates and/or difficult travel periods, Casons Travels PVT Limited furthermore reserves the right to modify its cancellation terms.

Strikes, unpredictable events
In case of strikes, any other unpredictable event or events that cannot be influenced by Casons Travels PVT Limited, Casons Travels PVT Limited will try the best to provide you the services booked (i.e. Casons Travels PVT Limited tries to transfer clients to an airport which is not on strike). Such incidents cannot be mentioned as a reason for the cancellation of a journey. Under no circumstances Casons Travels PVT Limited will be responsible for any caused damage.

2.       Your Agreement With Us and Your Acceptance of these Terms and Conditions
By booking your arrangement with us or using our website, you are agreeing to be bound by the terms of these General Terms and Conditions, including its Parts 1-3 and any additional terms and conditions of any Supplier that are applicable to your booking, travel arrangements or use of any website content You agree on behalf of yourself and those you represent to comply with all such terms and conditions, including the payment of all amounts when due. You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, (o) you being denied access to the applicable travel related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation.
You represent and warrant that (a) you are of sufficient age to use our services (at least 18 years old) and website and can create binding legal obligations in connection with your use, (b) you are legally authorised to act on behalf of those you represent and accept these terms and conditions on their behalf, and(c) the information supplied by you or members of your group is true and correct You are responsible for informing such other persons of all terms and conditions applicable to their travel arrangements. You understand that you are financially responsible for any use of our services or website by you and those using your name or account.

If You Change Your Booking
Where a change requested by you to your travel arrangements is permitted and possible, our standard service fees will apply. Please note that all reservation changes are subject to availability and rates may fluctuate at that time.
Changes to name details are not allowed by many airlines and other Suppliers. While we will endeavour make such a change if necessary, please bear in mind that most airlines and Suppliers treat a name change as a cancellation, to which standard conditions and charges would apply.
Flights must be taken in the sequence they appear on your ticket or e-ticket confirmation. If you plan not to take a flight as booked, please contact the airline as far in advance as possible to discuss your options. If you do not check in on time for a confirmed reservation, the airline may register you as a ‘no-show’, which could result in extra charges and/or your whole flight itinerary being cancelled and/or render your ticket void.

If You Cancel Your Booking
If you cancel your arrangements, you may be entitled to a partial refund, under the condition of the paragraph from point 1 from above called “Cancellation fees”.

Important Notice Regarding Airline Reservations
If you arrive at an airline ticket or passenger check-in counter with your confirmed ticket and find that the airline shows no reservation for you-do not leave the counter. Check your ticket. If the status box shows “OK” for the flight in question, the airline policies typically require them to accommodate you on that flight, or if that is not possible, they must either find you a substitute flight or pay you denied boarding compensation. If necessary ask to speak to a supervisor.

If You Have A Complaint
If you have a problem during your holiday, you must firstly inform the relevant local Supplier (e.g. your hotel, restaurant, cruise ship, etc.) immediately about the complaint and the issues must be solved at place, is possible. Should they be unable to resolve the matter, please immediately contact us by email: info@casonstravel.com. If you fail to contact us on time, we will not be permitted the opportunity to investigate your complaint and attempt to rectify any error while you are away, and this may affect your rights under this General terms and conditions. All the complaints have to be sent or communicated to Casons Travels PVT Limited in written form, within a maximum 7 calendar days after the end of the tour. Please note that you must firstly communicate your complaint to your relevant local Supplier, if not, a complaint addressed firstly to us shall not be relevant.

Travel Documents and Destination
It is your responsibility to ensure that all of the details on your travel documents are correct and to bring to our attention any errors or discrepancies immediately. Your travel documents are valuable and should be safeguarded as if they were cash. It is not always possible to replace travel documents in the case of loss, theft, damage, etc.
Prior to booking international travel, we recommend that you review any Government’s prohibitions, warnings and advisories applicable to your destinations. By offering travel to any particular destination, we do not represent that travel in such destination is safe or without risk.

Passport, Visa and Immigration Requirements
It is your responsibility to fulfill the passport/identity card, visa and other immigration requirements applicable to your itinerary. You should confirm these with the relevant embassies and/or consulates. We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements.

Insurance
Travel insurance is a vital part of your arrangements. We strongly recommend that all passengers are adequately insured before travelling abroad, for the whole duration of your journey. In any event, we strongly advise that you take out a policy of insurance in order to cover you and your party against the cost of cancellation by you; the cost of assistance (including repatriation) in the event of accident or illness; loss of baggage and money; and other expenses.

Travel Advice and Vaccinations
Vaccinations may be required for some or all of the places you are intending to visit. It is your responsibility to ensure that you have arranged all necessary vaccinations for your itinerary or any special safety requests.

Use of our Services and Website
You agree you will only use our website or services to make legitimate reservations or purchases and shall not make speculative, false or fraudulent reservations or reservations in anticipation of demand. You will only use our website and services in compliance with applicable law.
Without our prior written permission, you may not (a) access, monitor or copy any content or information on our website using any “robot”, “spider” or other automated or manual device or program, (b) deep link to any portion of our website, or (c) “frame” or incorporate any portion of our website into any other website.


3. Additional Terms
The information, software, products and services provided by us or our suppliers or published on our website may include inaccuracies or errors, including pricing errors. We do not guarantee the accuracy of, and disclaim all liability for any errors or other inaccuracies relating to such information that appears on our website. We expressly reserve the right to correct any pricing errors on our website and/or on pending reservations made under an incorrect price. In such event, if available, we will offer you the opportunity to keep your pending reservation at the correct price or we will cancel your reservation without penalty.
We reserve the right at any time to modify this Agreement without prior notice to you. Please refer to our website from time to time to review the most current version of the GTC.

PAYMENT OF THE TOUR PRICE CONSTITUTES YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS SET OUT HEREIN.
